Welcome to Pholi Photography. By accessing and downloading images from our online gallery, you agree to the following Terms and Conditions. Please read them carefully.

1. Definitions
Client refers to the person(s) or entity that has purchased or been granted access to the online gallery.
Photographer refers to Pholi Photography, its employees, and contractors providing photography services.
Images refers to any photographs, digital files, or downloadable content provided to the Client through the online gallery.

2. Access to the Online Gallery
The Client will be provided access to their online gallery via a unique link or login credentials. This access is for personal use only and must not be shared with third parties without the express permission of the Photographer.
The gallery will be available for download for a period of one year from publishing. After this period, access to the gallery may be revoked, and the images will no longer be available for download unless otherwise agreed.
It is the Client’s responsibility to download and back up the images before the gallery expiration date.

3. Image Quality and Format
The Photographer will deliver high-resolution, professionally edited images via the online gallery.
Raw or unedited images will not be provided.
The images are delivered in JPEG and are suitable for printing and personal use. The Photographer does not guarantee compatibility with all devices, systems, or software.

4. Image Download and Delivery
Upon full payment, the Client will receive access to download the images.
The Photographer is not responsible for any technical difficulties that arise from downloading the images due to issues with the Client’s device, software, or internet connection.
In the event of download difficulties, the Client should contact the Photographer within 7 days of receiving the download link.

5. Payment
Full payment is required before access to the online gallery and image downloads are granted.
Payments are non-refundable once the Client has accessed or downloaded any portion of the gallery.
The Photographer reserves the right to deny access to the gallery if full payment has not been received.

6. Copyright and Usage
The Photographer retains full copyright and ownership of all images. By accessing the online gallery, the Client is granted a limited, non-exclusive, non-transferable license for personal use only.
The images may be printed for personal use, shared on social media platforms (with credit to the Photographer where possible), and enjoyed privately by the Client and their family.
Commercial use of the images, including but not limited to resale, publication, or distribution for profit, is prohibited unless explicitly agreed upon in writing with the Photographer.
The Client agrees not to alter or edit the images in any way, including applying filters through social media apps, without the Photographer’s prior approval.

7. Gallery Security and Privacy
The Photographer takes security seriously and will make every effort to ensure the privacy of the online gallery. However, the Photographer cannot guarantee complete protection against unauthorized access due to technical or online vulnerabilities.
The Client is responsible for safeguarding their login details or download link. Any sharing or unauthorized access to the gallery by third parties is prohibited unless permission is explicitly given by the Photographer.

8. Limitation of Liability
The Photographer will not be held liable for any loss or damage arising from technical failures, internet outages, or other issues outside their control that may prevent access to the online gallery.
In the unlikely event of image loss due to a technical failure or unforeseen issue, the Photographer’s liability is limited to refunding any payments made or rescheduling a session, where possible.
Once the Client has successfully downloaded the images, the Photographer is no longer responsible for maintaining copies of the images. It is the Client's responsibility to back up and store the images after downloading.

9. Image Retention
The online gallery will be available for download for 1 year after gallery delivery, after which the gallery will expire.
After the gallery expiration, the Photographer is not responsible for archiving or storing images. If the Client fails to download the images within the allocated time, additional fees may apply to restore the gallery and re-enable access.

10. Refunds and Cancellations
Due to the digital nature of the product, all sales are final once the images have been downloaded.
If the Client encounters issues accessing or downloading their images, they should contact the Photographer within 7 days of gallery delivery for resolution. Refunds will not be issued unless access to the gallery or image downloads cannot be provided due to technical reasons solely within the control of the Photographer.

11. Force Majeure
The Photographer is not liable for any delay or failure in performance resulting from events beyond their reasonable control, including but not limited to acts of nature, technical failures, or disruptions in internet services.

12. Agreement
By accessing the online gallery and downloading the images, the Client agrees to these Terms and Conditions.
These Terms and Conditions are subject to change, and the latest version will be made available on pholiphotography.com
